Olson is definitely a big gun if they are going to pursue an en banc review and/or an appeal to the Supreme Court. Will be interesting to see if that's enough to sway the odds.

Glad it came during the draft so Goodell has to realize that is NOT "the end of the matter". If nothing else, the NFL is ingenuous with their "victories" in this sordid affair.

MY Big GUN is BIGGER than your Big GUN!!!! Olsen already pointing out that this isn't just about Tom Brady, It's about the rights of everyone in a union, and the decision written by Chin and Parker will have far reaching effects not just on this case. So now he's opened a much broader view of this issue. That could change everything. I still think it comes down to the fact that Brady wasn't treated fairly and didn't have a far opportunity to tell his side.
I think he's already laying the ground work for the Supreme Court.

lol, you bring an appeals lawyer I'll bring a supreme court lawyer. You bet Olson is going to turn this into a labor argument which is why the Supreme court would hear it. They wouldn't hear a punishment case but they would hear a labor case

Well Clement and Olson are pretty much equals when it comes to Supreme Court credentials, but the NFLPA is definitely taking things up a notch with this move. I think the biggest thing Olson brings is the ability to present his case in a way that might be more effective with top tier judges both on the Second Circuit Court and, if they try to appeal there, the Supreme Court.
It's still a long shot to get an en banc review or to be heard in the Supreme Court, but at least the NFLPA now has counsel that will give them the best possible chance of being heard. Kessler is a good labour lawyer, but he's not the kind of lawyer known for arguing fundamental law.

I think the NFLPA is pretty ticked off on old Goodell now after he open his mouth and said all they were interested in was that they wanted to remove punishment of any kind for the players. I say now is the time to hit him with a defamation of character suit at the same time. Keep them tied up in court for the foreseeable future. I bet a lot of fans would contribute to his legal expenses just to see old roger dodger squirm. Stay away for Maine Roger. I hear you could build a really nice place in Indiana or Maryland.

Reading opinions that this a small issue of just the CBA is sort of limited in thinking
These Judges poopooed the Union arguments as just hyper technical
Well there are labor laws. And the NFL dispensing it's own brand of Justice?
There are rules any arbitrator has to follow. Goodell broke a few.
It sort of is amazing g that these two judges basically said that Goodell could make anything up and then even ban someone for life based upon it
IMHO Goodell could have gotten away with it ( and still might) because the NFL was so clumsy from Day 1 right thru to Hoodells final ruling, In the end was Brady treated fairly under the law?
The unfairness of how Brady was treated is not open for debate. Anyone saying different needs to put themselves in the same position Tom Was and then tell everyone how good it is
What we have now How persuasive this Ted is? Did this opinion fall within the guidelines of the original SC decision? The top judge in the 2nd court dissented The decision was only 2-1 and the last court was over ruled Chin and Mara are buddies, should this have been disclosed and should Chin Have Recused himself?
I heard that the en banc appeal could take a long time. Brady may still play in game 1

Yes. good to see a move made DURING the draft. But best is simply that this GOES ON. Fight this to the end. Lets hope the good guy finally wins this in the end. Then lets all go to see the movie. Who do you think will play TB? Brad Pitt? ANd who will play Gotohell? An old decrepit Busey?

I agree both are long shots - would have to say that the odds just shortened a little a least, otherwise why would Olsen take the case? Probably a better chance for Certiorari being granted then the En Banc hearing - I would say there is legitimate justification for the Supremes to take this case on - despite what you have said Prolate, the Appelate decision takes Article 46 well beyond any reasonable interpretation of it - it is incumbent upon the finders of fact to glean the intentions of the parties in any agreement where the issues aren't explicitly agreed to - there is no explicit agreement that ball pressure violations constitute conduct detrimental, nor was there any past finding by the NFL that any such violation would result in a finding of conduct detrimental - so there can be no argument that the NFLPA collectively agreed to this scenario of punishment knowingly it it seems to me that Judges Berman and Katzmann have a legitimate point, is any arbitrator allowed to substitute their own brand of Industrial Justice simply because an "Article 46" says they can? I hope we get a chance to find out

I just started reading the decision. In the very first page of the Background, they made a mistake They said the LB Jackson who intercepted the ball felt there was something g wrong with it Hmm, I don't know how to tell these idiots, but he didn't notice anything, it was the colt EM with an illegal needle who complained
Maybe I am "hyper technical" But these turds didn't know the facts at the hearing and certainly are clueless now. This really is an embarrassment of two crappy ivy league lawyers. Now I know their legal assessment is worthless. Just a couple of political hacks. . ****** I just read the background on the gages, and Colt and Pat balls, almost as bad No wonder pro thought this was a great air tight decision

Ted Olsen is a legend in Washington...don't forget he just won the Gay Marriage case in the Supreme Court along with a legal legend liberal "foe" as his co-counsel, David Boies, so he is known for his love of the LAW, not just dogmatic politics. He also garners tremendous sympathy because his much respected lawyer wife , Barbara Olsen, a regular commentator for Fox Network and Politically Incorrect, died in one of the ill fated hijacked 9/11 flights. So yes, TFB is going for the whole enchilada. This ain't no disco, this ain't no foolin' around!
