Mike McCann just now on EEI said Brady needs to file suit. Said if he's innocent then he almost has an obligation to. Also Shefner just tweeted out Tom Brady not accepting decision and it's far from over. Goooooooooo Tom I heard that on Comcast sports. Just go right to the end. Who cares at this point. It doesn't matter what the Media( most are snakes) talk shows ( all for the ratings) think. I always respect what McCann has to say if he thinks their is a chance be it slim, just go for it anyway. I go right to the bitter end. Even if it is a Hail Mary.

Wouldn't have made any difference This was the NFL vs the Union Tom would have been fighting the same fight The only thing Tom has out side of the Union is a defamation suit The NFL has deep pockets, Tom Doesn't Maybe his friend Trump helps HM? If he does do it, and does get by a summary dismissal, he has to give the net proceeds back to the players I dont buy the "He is a celebrity" defense either LOL at your avatar, Crooked HILARY and Lyin TED....

I (of course ) blame Kraft. Kraft could have made a stink early, could have released the real data to counteract Morts BS and a number of things to quell this right away. He just laid there and asked for more. Someone has naked pictures of Bob with a sheep. I of course blame BB. His arrogance really rubs a bunch of people in the NFL the wrong way. I'll agree with that he certainly set the table. It's a messed up league if they "waited in the weeds" to torch the pats I have the nfl network but it would be easier and cheaper to have a slingbox hooked up to a DVR at my moms house in CT. I cancled the NFLN but they gave it too me for free.

Summary judgement not possible. Too long/boring to explain why but TB's only hope if winning a defamation case would require a full trial. He has the resources, it's whether hecwantsctobexpose not only the league's warts but his own as well. A suit like that would be expensive, time consuming, personally and professionally fraught with danger and very possibly fruitless so it's not something most attorney's would encourage. I don't think the point was that Tom could win a summary judgment against the League. I believe the general thought process in this has been that Tom's claim cold itself survive a summary judgment motion and allow the claim to proceed to discovery. Belief around here, myself included, is that the discovery materials, and any potential depositions of League employee's, would be rather bad for the League. Thank you Tom has to get by the first hurdle of a judge allowing Tom to suit to go forward and not summarily stop the suit if he gets by that, then Tom can call witnesses

From Mike Florio, First, a request for rehearing (which must be filed if at all within 14 days) operates as an automatic stay of the suspension. It means that Brady, if a petition for rehearing is filed, would have his suspension held in abeyance until, at the earliest, the Second Circuit decides not to conduct a rehearing and, at the latest, until the rehearing is resolved with another ruling against Brady and the NFLPA Florio must be changing his tune. He went on and on in a vid about how the case could still be pending after Brady has already served the suspension.

All this BS is on one person Roger! Without him all this deflate gate crap cannot happen. Heck even if there was a video of Tom telling them to deflate the balls below the legal limit the penalty for such an infraction was a fine, never a four game suspension!!!!! Let's get the four game suspension over and God help the rest of the teams in the Patriots schedule after Tom returns. I'm sick to death of this!

Jeffrey Kessler is one of the best labor lawyers in the country. The problem is the players union negotiated a shitty CBA. It's true that Kessler is one of the best, but he was also part of the team that negotiated the CBA.
The real problem is that labour is almost always at a disadvantage in these negotiations because the employees simply can't afford not to work and the employer often has deep enough pockets to suspend business until the employees go broke.
Football players make a lot of money, so you'd think they'd be able to wait out employers better than most employees, but football players also have notoriously short careers so losing a year is a significant blow to their career earning potential, many of them actually make good but not extravagant salaries, and many are not in strong financial position even if they are earning very good wages. So players weren't really willing to forego a season to win in bargaining. That's why a deal was reached hurriedly at the last minute before the 2011 season was delayed.
Kessler's strategy during negotiations, of course, was to threaten decertification. The question I have is whether this was ever a serious threat. Decertification terrifies the owners. I know it seems weird but owners want a union every bit as much as players do—maybe even more. As long as there is a union and a CBA, the owners can do things like have drafts and regulate free agency. Once a union is gone, all that stuff becomes illegal. Players coming out of college would have the right to negotiate with every team to find the best deal (just like you and I can negotiate with multiple employers when we look for a job). While individual employment contracts could limit players' rights to move around a bit, all the restrictions of free agency and waivers would disappear and players (and their agents) could negotiate whatever terms they wanted. Owners could buy players out of their contracts with other teams. It would become a true free market for talent, and star players would likely do very well. The downside for the players is that average talents might make very little and would have a lot less protection. I believe European soccer is very much a free market system like this, so there's a precedent. I'm just not sure the NFLPA was ever really serious about taking itself out of business. Kessler threatened that. But I think the owners called his bluff.

Think about it.. this whole thing hangs on one piece of information - the fact McNally took the bag of footballs into the restroom. The NFL hangs this entire thing on their belief in the 90 seconds in the restroom McNally needled each of the footballs. That is their entire circumstantial case.
